What is

Collaborative Divorce?

Collaborative divorce is an alternative to going to court and is designed to handle divorce and family issues in a respectful, fair way. Like mediation or arbitration, it helps couples resolve things outside the courtroom.

The goal is to reach a settlement that works for both sides—and their kids—without the stress and uncertainty that comes with litigation.

Collabortative Divorce is a court approved process and we are a proud member of the NJ Council of Collaborative Practice Groups. Learn more at: https://collaboratenj.org/

It avoids the usual legal battles.

What makes collaborative divorce different is that it avoids the usual legal battles. Instead of increasing tension, it focuses on respect and teamwork.

You and your spouse stay in control of the process while working with your lawyers to come up with solutions that fit your unique situation—rather than settling for a one-size-fits-all court decision.

Each person selects

their own attorney.

In a collaborative divorce, each person picks their own attorney and agrees to stay out of court while working toward a settlement. That makes the process more open and less combative.

Your lawyer acts more like a problem-solver than a fighter. The aim is to keep communication clear and constructive, laying the groundwork for a better relationship after the divorce.

Solutions that benefit both sides

Unlike a court case, you decide when, where, and how often to meet. Everyone involved is focused on finding solutions that benefit both sides. There’s no win-lose mindset.

It’s just a team effort to build an agreement that works for everyone. Often, the first step is creating a plan for good communication and building enough trust to move forward.

Working in partnership with

other professionals

Depending on your case, your team can bring in other neutral professionals—like mental health experts, child specialists, divorce coaches, financial planners, or mortgage bankers—to help with specific concerns.

If needed, we’ve got the right people to guide you and your spouse through the important decisions.

It’s designed to be civilized.

Collaborative divorce is designed to be civilized, respectful, thoughtful, and creative. It’s for people who want to find a solution to separation rather than assign blame. It’s for parents who want to co-parent well and protect their kids from conflict.

It’s for people who want to stay in control of the outcome—and value peace, privacy, and a better quality of life after divorce.

What are the benefits?

A Collaborative divorce can give children a voice in the process, alleviating the potential of future trauma that sometimes persists for generations. Collaborative divorce keeps assets and personal problems private.

It aims at improving communication between parties, keeping control of the divorce process in the hands of the parties and promoting respect and healthier long term communications.

By avoiding costly litigation, collaborative divorce preserves more of the family’s finances for the future. Respectful relationships between the parties can also be preserved. And, perhaps, most important, children do not become pawns in the divorce or subject to the stress of ongoing legal proceedings.
